National Policy Framework for Artificial Intelligence: Ensuring US Leadership (2026)

The race for Artificial Intelligence (AI) supremacy is on, and the United States is at a critical crossroads. Bold action is needed to ensure we don’t lose this technological arms race to global adversaries. As President, I’ve made it clear: America must lead in AI, not just for economic dominance but for our national security. My administration has already taken significant steps to remove barriers to AI innovation, updating federal regulations to encourage adoption across sectors. These efforts have unlocked trillions in investments and delivered immense benefits to Americans. But here’s where it gets controversial: while innovation thrives with minimal regulation, a patchwork of 50 state-level AI laws threatens to stifle progress. State regulations, though well-intentioned, often create compliance nightmares for startups and, worse, can force AI models to produce biased or even false results to avoid legal pitfalls. For instance, a Colorado law aimed at preventing ‘algorithmic discrimination’ might inadvertently mandate AI to skew outcomes, undermining its very purpose. And this is the part most people miss: some state laws overreach, regulating beyond their borders and disrupting interstate commerce.

To win this race, we need a unified, minimally burdensome national AI policy framework—one that protects innovation, safeguards children, prevents censorship, and respects copyrights. Until such a framework exists, my administration will actively challenge state laws that threaten to derail our progress. We’re establishing an AI Litigation Task Force to combat state regulations that conflict with federal policy, and we’re evaluating state laws to identify those that hinder innovation or violate constitutional rights. But here’s the kicker: we’re also tying federal funding to compliance, ensuring states with overly restrictive AI laws don’t undermine our national mission.

Is this the right approach, or are we risking too much by limiting state control? I’m calling on Congress and the American people to join this conversation. AI is the future, and how we regulate it today will determine our global standing tomorrow. Let’s ensure America leads—not just competes—in this transformative era.
